  • Legal guarantee of conformity
    • Definition

In order to comply with these GTC, the product must be suitable for the use usually expected of a similar product and, where applicable, must:

- correspond to the description given by ELWING and possess the qualities that the latter has presented to the Client;

- have the qualities that a Customer may legitimately expect, taking into account the public statements made by ELWING, particularly in advertising or labelling;

Non-conformities that appear within twenty-four (24) months of delivery of the goods are presumed to have existed at the time of delivery, unless proven otherwise.

  • Enforcement

The customer is entitled to demand that the product conforms to the contract. However, he may not contest the conformity by invoking a defect that he knew or could not have been unaware of at the time of the conclusion of the contract. The same applies when the defect originates in materials that he himself supplied.

In the event of a lack of conformity, the customer may choose between repair and replacement of the product.

When replacement of the product is impossible, the customer may return the product and be reimbursed the price or keep the product and be reimbursed part of the price.

The application of the provisions of articles L217-4 to L217-14 of the Consumer Code is free of charge for the customer.

The seller delivers goods in conformity with the contract and is responsible for any lack of conformity existing at the time of delivery.

He is also responsible for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was attributed to him by the contract or was carried out under his responsibility.

  • Article L217-5

The goods are in conformity with the contract :

1 ° If it is suitable for the use normally expected of similar goods and, where appropriate :

- if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model ;

- if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2 ° Or if it has the characteristics defined by mutual agreement between the parties or if it is suitable for any special use sought by the buyer, brought to the attention of the seller and that the latter has accepted.

  • Article L217-10

1° If the solution requested, proposed or agreed upon pursuant to Article L. 217-9 cannot be implemented within one month of the buyer's complaint;

2° Or if this solution cannot be without major inconvenience for him given the nature of the good and the use he is seeking.

The cancellation of the sale cannot however be pronounced if the defect of conformity is minor.

The action resulting from the defect of conformity is prescribed by two years after the delivery of the goods.

  • Warranty against hidden defects
    • Implementation

The Customer may, after prior notice from the site manager and an attempt at amicable resolution, implement the warranty against hidden defects.

  • Legal provisions - Civil Code
    • Article 1641

The seller is bound by the warranty for hidden defects of the thing sold that make it unfit for the purpose for which it was intended, or that so diminish this use that the buyer would not have acquired it, or would have given a lower price, if he had known.

  • Article 1648

The action resulting from latent defects must be brought by the buyer within two years from the discovery of the defect.

  • Manufacturer's warranty
    • What does the manufacturer's warranty cover?

The manufacturer's warranty covers all return shipping costs for cards purchased from one of our authorized dealers or from our website.

IMPORTANT: Our warranty is not valid outside the European Union.

    • Condition of the manufacturer's warranty

This guarantee is exceptional and applies to normal use of the commission. We therefore rely on the honesty of our customers.

    • Procedure for warranty coverage:

Our customer service will contact you as soon as possible to establish a remote diagnosis.

In most cases, the problem can be diagnosed remotely and therefore repaired quickly. We therefore rely on the honesty of our customers as to the reason for the failure.

    • In which cases can the manufacturer's warranty be refused?

Reminder of the law on commercial warranties: "As this warranty is a complement to the legal warranties, the manufacturer sets its own conditions".

We would like to remind you that our goal is to accommodate our customers as best as possible in order to satisfy them. But in the following cases, we will refuse to accept your product under the manufacturer's warranty:

  1. Disrespect to our team: Any person who shows disrespect to our team will lose the manufacturer's warranty.
  2. Honesty: Anyone who has not been truthful about the origin of the defect and has wasted our team's time will forfeit the manufacturer's warranty.
  3. Anyone who deliberately degraded the brand, issued a negative review or revealed their failure on social networks without contacting our customer service first.
  4. Presence of water traces inside our components.
  5. Defects caused by a fall or any other event that is not related to a defect in the board.
  6. Damage during transport.


    • Parts covered by the manufacturer's warranty:

The warranty ends when either term is reached.

For the Yuvy:

This warranty takes effect from the date of purchase. It is granted only for normal use of the bicycle.

The frames and all components mounted on our bikes are guaranteed against manufacturing defects for a period of 2 years.

The battery is guaranteed to have a minimum residual capacity of 70% after 2 years or 500 full charge cycles.

The finishes are guaranteed against manufacturing defects for a period of one year from the date of purchase.

For all POWERKITs:
